TWO IS THE RETENTION DATA FOR RELATED RECORDS. IS PASSPORT PROHIBITED FROM SELLING, MONETIZING OR OTHERWISE COMMERCIALLY UTILIZING DATA GENERATE THROUGH THE CITY'S USE OF THE SYSTEM? IF PASSPORT LABS WERE ACQUIRED, MERGING OR OTHERWISE TRANSFERRED TO ANOTHER ENTITY, WHAT PROTECTIONS EXIST FOR CITY DATA.

FIVE, IS ANY THE DATA STORED OUTSIDE OF THE UNITED STATES? SIX. DOES THE SYSTEM INTEGRATE WITH FLOCK OR ANY OTHER THIRD PARTY LAW ENFORCEMENT DATA SHARING NETWORK? SEARCH, UNDER WHAT CIRCUMSTANCES MAY DATA BE SHARED WITH FEDERAL AGENCIES OR OTHER GOVERNMENTAL ENTITIES? EIGHT, WHAT PROVISIONS EXIST

REGARDING DATA DELETION OR RETURN OF CITY DATA UPON TERMINATION OF THE AGREEMENT? NINE, HAS THE OFFICE OF CORPORATE COUNSEL REVIEWED THE AGREEMENT WITH RESPECT TO DATA PRIVACY OWNERSHIP, RETENTION, AND SHARING PROVISIONS THAT ARE THERE AND ARE THERE ANY OTHER CONCERNS IN THOSE AREAS? AGAIN, I WAS NOT RAISING THESE QUESTIONS FOR A POSITION WHETHER I WAS FOR OR AGAINST THE SYSTEM, BUT I THINK THESE ARE QUESTIONS THAT CAME TO MY MIND THAT AROSE AS I READ THE PROPOSAL.

SO, CHIEF, EITHER YOU OR BENJAMIN, EITHER CAN OR HOWEVER YOU WANT TO ADDRESS THIS. I HAVE TALKED TO BENJAMIN PRIOR TO THIS MEETING. I FEEL SATISFIED THAT THESE QUESTIONS HAVE BEEN ANSWERED, BUT, THE PUBLIC MAY WANT TO KNOW AND MY OTHER BOARD MEMBERS MAY WANT TO KNOW AS WELL.

SYSTEM. >> SO, WHAT COUNCIL DID IS THEY APPROVED THE ABILITY FOR THE CLERK TO ASSIGN AN AGENT FOR COLLECTION OF FINES. RIGHT.

BECAUSE THIS IS PARKS GOES UNDER THE ORDINANCE BUREAU, THE STATUTORY CREATURE THAT COUNCIL BROUGHT INTO PLAY IN THE CITY AND DESIGNATED THE CLERK AS THE VIOLATIONS CLERK TO ADMINISTER.

WHAT THAT MEANS IS AVOID COURT. IF YOU GET A PARKING TICKET YOU CAN PAY THE SMALL FINE THAT THE COUNCIL HAS SET AND IF YOU PAY THAT FINE WITHIN THE TIME PERIOD SET BY CITY CODE, THEN IT DOESN'T GO TO COURT AND COURT FEES AND APPEARANCE AND FINES THAT CAN ESCALATE. IT'S AN ADMINISTRATIVE BENEFIT TO HELP WITH COMPLIANCE, AND ENFORCEMENT.

SO, IN ORDER FOR OTHERWISE THE CLERK WOULD BE COLLECTING ALL THESE FEES MANUALLY, DEPOSIT AND IN ORDER FOR THE FEES TO BE COLLECTED BY ANYONE ELSE OTHER THAN THE CLERK, IT NEEDED TO BE DONE BY LEGISLATION. THE CLERK CAN DESIGNATE AN AGENT. IN THIS INSTANCE, THE CLERK WOULD DESIGNATE PASSPORT IF THEY ARE THE ENTITY THAT ENDS UP WITH THE CONTRACT TO PROCESS ENFORCEMENT FOR AND COLLECTION

OF FINES FOR PARKING. >> OKAY.

>> SO THIS IS THE MAIN MEAT AND POTATOES IN THE CONTRACT BECAUSE THAT'S WHERE THE AGREEMENT TAKES PLACE TO ALLOW THEM TO BE ABLE TO MOVE FORWARD AND THEN THE CLERK CAN DESIGNATE AS

>> I WILL PROVIDE A BROAD OVERVIEW, WE HAVE EXTENSIVE DATA LANGUAGE THAT IS INCLUDED. PASSPORT HAS THEIRON DATA PROTECTION LANGUAGE THAT IS TO BE VERY CLEAR, THE CITY OWNS THE DATA. THIS IS VERY LIMITED DATA AS WELL. I MEAN, THIS IS LICENSE PLATE INFORMATION ON CITY STREETS AND CITY PROPERTY.

BUT, THE CITY OWNS DATA. AND THAT DATA IS LIMITED ONLY FOR THE PURPOSE OF ASSISTING THE CARMEL POLICE DEPARTMENT WITH ENFORCEMENT. THAT'S THE LIMITED PURPOSE OF THE DATA. IT CANNOT BE USED FOR A COMMERCIAL PURPOSE. IT CANNOT BE SHARED FOR ANY OTHER PURPOSE OTHER THAN FOR THE ENFORCEMENT OF PARKING FOR THE CARMEL POLICE DEPARTMENT. UNLESS REQUIRED BY LAW.

BUT OTHERWISE, IT IS HEAVILY PROTECTED INFORMATION AND DATA AND HEAVILY SECURE SYSTEM. THE RETENTION OF THIS WE, THE LANGUAGE WITHIN THE CONTRACT, PASSPORT HAS THEIR OWN RETENTION SCHEDULES. WE INCLUDED CLEAR LANGUAGE IN THE CONTRACT THAT HAS THIS DATA TO BE DELETED WITHIN 60 DAYS AT THE TERMINATION OF THE AGREEMENT OR IT HAS TO BE DONE MANUALLY WITHIN 180 DAYS AND THAT LANGUAGE IS THERE FOR YOUR REVIEW. THERE ARE NO CONCERNS THAT I HAVE IN RELATION TO THIS AGREEMENT.

WE HAVE LANGUAGE IN THERE THAT INDEMNIFIES.

WE HAVE LANGUAGE IN THERE THAT LIMITS.

WE HAVE LANGUAGE IN THERE THAT CONTROLS.

SO, THE RISK IS VERY MINIMAL TO THE CITY.

MY STRONG CONCERN WAS THAT THE DATA WOULD BE SOLD FOR COMMERCIAL PURPOSES. DATA ON CARMEL RESIDENTS WOULD

IT'S OUR DATA AND CANNOT BE USED FOR THAT PURPOSE.

YOU ASKED A QUESTION REGARDING ACQUISITION.

WHEN IF THAT OCCURS, WE HAVE ACQUISITION LANGUAGE WITHIN CLAUSE WITHIN OUR CONTRACT THAT SAYS IT REQUIRES BEFORE THE DATA IS TRANSFERRED IT REQUIRES APPROVAL BY THE CITY.

SO WE HAVE THAT SECURITY AS WELL.

JUST SO TO THE EXTENT THERE ARE ANY CONCERNS OUT THERE IN THE PUBLIC RELATED TO THIS, PASSPORT IS THE PREMIERE SOFTWARE PROVIDER FOR THIS LEVEL OF SERVICE.

OVER 800 MUNICIPALITIES IN RELATION TO PARKING ENFORCEMENT.

I BELIEVE A COUPLE ALREADY WITHIN OUR OWN COUNTY.

AND SO, THEY ARE HEAVILY INVESTED IN DATA PROTECTION AS WE EXPECT THEM TO BE AND WE HAVE HEALTHY LANGUAGE IN THERE THAT OFFERS BROAD PROTECTION FOR LIMITED DATA.

IT'S A LIMITED SUBSET OF DATA WHEN IT COMES FOR LICENSE PLATE.

THE CONCERNS SHOULD BE MINIMAL AND WE HAVE DONE OUR BEST TO BE ABLE TO RECOGNIZE THEM TO ADDRESS THEM IN THIS CONTRACT.

IN FACT WE HAVE EVERY OTHER WEEK WE HAVE A STANDING MEETING TO ADDRESS I T-RELATED ISSUES AND ONE OF BIGGEST CONCERNS OVER THE LAST COUPLE YEARS LONGER HAS BEEN CYBERSECURITY DATA PROTECTION AND DATA SHARING, SO WE HAVE DEVELOPED AT THIS POINT PROBABLY ABOUT THREE YEARS AGO PERHAPS AN ADDENDUM THAT COVERS A LOT OF ISSUES THAT BENJAMIN ADDRESSED AND YOU WERE CONCERNED ABOUT.

EVERY TIME THERE'S A CONTRACT OR AGREEMENT THAT HAS AN IT SOFTWARE INSTALLATION, ANY SORT OF INTEGRATION WITH OUR SYSTEM OR DATA SHARING, IT GOES THROUGH I T REVIEW FIRST.

SO IT'S NOT ONLY US LAWYERS LOOKING AT THE LANGUAGE PORTION OF IT, IT'S ALL OUR IT DEPARTMENT LOOKING AT ACTUAL OPERATIONAL PORTION HOW IT WORKS.

THIS WAS NOT AN EXCEPTION. I JUST CONFIRMED WITH STAFF.

WE WORKED THROUGH A LOT OF UTILITIES AND PROBABLY FORTUITOUS IT LOOK THIS LONG. THEY ARE ALL ON THE TABLE TO GO AND DIRECTOR YOUNG'S PROJECT. BECAUSE OF THE WORK IN THE AREA, WE FEEL THE BOT METHOD IS GOING TO REALLY SERVE THE CITIZENS OF CARMEL BECAUSE OF THE COMPLEXITY.

THIS IS A UNIQUE PROJECT. WE DON'T HAVE A LOT THAT ARE SUPER DEEP LIKE THIS. WHEN THEY ARE DEEP, THERE'S A LOT OF POTENTIAL THINGS THAT CAN HAPPEN ONCE YOU GET IN GROUND.
